These Terms & Conditions ("Terms") govern your access to and use of coachingdept.com (the "Site") and any products, programs, or services offered by Coaching Dept., a brand operated by HD Advisory Consulting LLC ("Coaching Dept.," "we," "us," or "our"). By using the Site or purchasing from us, you agree to these Terms. If you do not agree, do not use the Site.
You must be at least 18 years old and able to form a binding contract to use the Site or purchase our products and programs.
We grant you a limited, non-exclusive, non-transferable license to access the Site for your personal and internal business use. You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, scrape content, or use it for any unlawful purpose.
The Site and all content, including the 3-3-5 Operator System, the Freedom Formula, Profit Builders, the Profit Catalyst App, text, graphics, logos, and frameworks, are owned by or licensed to Coaching Dept. and protected by intellectual property laws. You may not copy, reproduce, distribute, resell, or create derivative works without our written permission.
We offer products and programs that may include the Profit Catalyst App, Profit Builders, the Freedom Formula, and related coaching. Prices and offers are described at the point of sale. By purchasing, you authorize us and our payment processor to charge your payment method for the amounts shown, including any recurring fees you agree to until you cancel.
Refunds & Cancellation. The specific refund and cancellation terms for each coaching program are set out in the client services agreement you receive and sign before enrollment, and that signed agreement controls. In general: coaching programs include a 14-day satisfaction guarantee from your first paid session, less the value of any sessions already completed; after that period, monthly programs are non-refundable for services already rendered and may be cancelled with 30 days' written notice before your next billing cycle; paid-in-full programs follow the prorated refund schedule described in your agreement. Digital products, such as the Profit Catalyst App, are governed by the terms presented at the point of purchase. Fees for third-party tools are non-refundable.
Coaching Dept. provides education, coaching, tools, and frameworks. We do not guarantee any specific result, income, profit, or business outcome. Your results depend on many factors outside our control, including your effort, execution, market, team, and decisions.
Any revenue, profit, or growth figures referenced on this Site or in our materials are illustrative examples of what some clients have achieved. They are not typical, not a promise, and should not be interpreted as a guarantee that you will achieve the same or similar results. Building a business carries risk, and you may earn less, break even, or lose money.
Testimonials reflect the real experiences of individual clients. They are individual results, are not necessarily typical, and your experience will vary. Testimonials are not a guarantee of future performance or success.
Our content and coaching are for general business education only and are not legal, financial, tax, accounting, investment, or other professional advice. You are responsible for your own decisions and should consult qualified professionals for your specific situation.
The Site and all products and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Coaching Dept. and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site, our products, or our programs. Our total liability for any claim will not exceed the amount you paid us in the six (6) months before the claim.
You agree to indemnify and hold harmless Coaching Dept. from any claims, damages, and expenses arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
By providing your contact information, you agree we may contact you by email, phone, and text consistent with our Privacy Policy and Messaging Terms & TCPA Disclosure. You can opt out at any time.
The Site may link to or integrate third-party websites, products, and tools we do not control. We are not responsible for their content, policies, or practices.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services will be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules, seated in Florida, with each party bearing its own arbitration costs. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida for any matter not subject to arbitration. Nothing here prevents either party from seeking injunctive relief to protect intellectual property or confidential information.
We may update these Terms from time to time. The "Last Updated" date reflects the latest version, and your continued use of the Site after changes means you accept them.
